Terms of Service

Techubs Network ( "Techubs", “we”, “us” ) provides the Services ( defined below ) to you ( “You”, “Customer”, “Subscriber” ) subject to the following Terms of Service ( "TOS" ), which may be updated by us from time to time without notice to you.

Please read the following TOS carefully before using the website or subscribe any service that Techubs offers.

  1. Services

    2. 1.1 The provision of Services between Techubs and the Subscriber is effective upon the acceptance by Techubs of the Application.
    1.2 All services Techubs offered are on pre-paid basis only. Service will be activated once the payment has been received.

  2. Term

    3. 2.1 The initial Term means the initial period for the provision of the services. The initial term and expiry date are stated in the email message generated from Techubs to the Subscriber.
    2.2 Upon expiration, the service purchased will NOT be automatically renewed. The same length of period as the Initial Term will be offered at Techubs’s then current rates for such Services.

  3. Hosting Renewal

    4. 3.1 All services will NOT automatically renew. We will notify you of your upcoming renewals with an invoice at least fifteen (15) days in advance.
    3.2 Customer will generally be invoiced on the thirty (30) days prior to expiry date.
    3.3 A renewal is only successful if we have notified you in writing that your application for renewal has been approved.

  4. Late Payments

    5. 4.1 If the renewal fee not fully paid and honored in accordance with the Payment Term set on our email notification, your account will be given a seven (7) day grace period. If payment is not made within the grace period, we reserve the right to suspend your service(s) with us.
    4.2 Thirty (30) days following suspension of Services for non-payment, we reserves the right to terminate Service(s) for non-payment.
    4.3 The Termination of Service means all files will be removed.
    4.4 All grace period for non-payment is not applied in Domain name registration and renewal service.

  5. Domain Name Registrations, Transfers and Renewals

    6. 5.1 We make an effort to send notification of pending renewal as a courtesy and obtain your consent to renew the domain name license by its expiry date. You will have no claim against us if we do not provide notification, or if notification does not reach you. It is your sole responsibility to ensure your electronic contact method is correct, active and fully functional.
    5.2 It is your sole responsibility to ensure your domain is renewed on time.
    5.3 If you fail to do so prior to the end of previous license term your domain may become available for registration by third parties.
    5.4 You release us from any potential claim arising from your failure to renew a domain name license or the domain name license become invalid.

  6. Cancellation and Termination

    7. 6.1 Either party may terminate the Service Agreement by providing notice to the other as provided herein.
    6.2 Customer can cancel the service within the first sixty (30) days and get a refund of remaining service period( Please refer to 6.5 specified the service excluded in the refund policy). We will charge 10% on the refund amount as the administration fee and deduct it directly in the amount of the refund.
    6.3 You can terminate any Service ( please refer to 6.5) at any time by using the web-based cancellation form. You are still responsible for all fees and charges accrued prior to the effectiveness of such cancellation.
    6.4 Cancellations are not final until confirmed by a representative of Techubs in writing by email.
    6.5 All refunds will be calculated by subtracting the following amounts from any fees paid by you:
    a. Set-up fees identified in the invoice;
    b. Installation fees for custom software;
    c. Website migration services;
    d. All fees related to domain name registration services;
    e. Any additional fees related to third-party services identified in the invoice ( e.g. SSL certificates).

  7. Suspension

    8. 7.1 If you breach of these TOS, Techubs may, in its sole discretion, restrict or suspend the Services, without prior notice to you and without an opportunity to cure the breach.
    7.2 Ongoing service fee will be charge during the period of suspension or restriction of services until we have receive a 7-days cancellation form from you.

  8. Back-up activities

    9. 8.1 Back-up activities are primarily for Techubs's own disaster recovery purposes, and that you are responsible for the storage, back-up and archiving of your content.
    8.2 "Your Content" means all materials, information, data or code that you upload, store, transmit, receive or process in connection with the Services.

  9. Service Availability

    10. 9.1 Techubs will use reasonable efforts to ensure that the web hosting services will be Available other than for "Scheduled Maintenance" at least 99.9% of the time, measured monthly.
    9.2 Any maintenance or other work takes place with at least 48 hours' prior notice posted to the website is "Scheduled Maintenance".
    9.3 A refund for failure to achieve the service levels will NOT be payable where such failure is a result of the scheduled and emergency maintenance.

  10. Spam, junk email or mass mailing

    11. 10.1 Techubs Network is NOT a mass email provider because sending mass amount of email will cause risks to our entire network. Our goal is to allow customer to send sufficient amount of email while our network will not suffer and our IP addresses will not be blacklisted.
    10.2 Customer are not allowed to use our service to transmit any spam, Junk-mail, unsolicited mass mail or other forms of spam. Any unsolicited mass email being sent will result in immediate suspension or termination of the offending account.
    10.3 In order to protect all of our customers, Techubs has zero tolerance for anyone sending unsolicited email or other forms of spam from Techubs Network.

  11. Indemnification

    12. 11.1 Customer agrees to indemnify and hold harmless Techubs's officers, directors, agents, and employees from and against any and all claims, demands, liabilities, obligations, losses, damages, penalties, fines, punitive damages, amounts in interest, expenses and disbursements of any kind and nature whatsoever ( including reasonable attorneys fees ) brought by a third party under any theory of legal liability arising out of or related to the actual or alleged use of Customer’s services in violation of applicable law or the AUP by Customer or any person using Customer’s log on information, regardless of whether such person has been authorized to use the services by Customer.

  12. Disclaimer of Warranties

    13. 12.1 Techubs does not warrant or represent that the services will be uninterrupted, error-free, or completely secure. To the extent permitted by applicable law Techubs disclaims any and all warranties including the implied warranties of merchantability, fitness for a particular purpose, and noninfringement. To the extent permitted by applicable law, all services are provided on an “AS IS” basis.

  13. Limitation of Damages

    14. 13.1 Neither party shall be liable to the other for any lost profits, or any indirect, special, incidental, consequential or punitive loss or damage of any kind, or for damages that could have been avoided by the use of reasonable diligence, arising in connection with the agreement, even if the party has been advised or should be aware of the possibility of such damages.
    13.2 Notwithstanding anything else in the agreement to the contrary, the maximum aggregate liability of Techubs and any of its employees, agents or affiliates, under any theory of law ( including breach of contract, tort, strict liability, and infringement ) shall be a payment of money not to exceed the amount payable by customer for three months of service.

  14. Acceptable Use Policy (“AUP”)

    15. 14.1 The Customer shall not distribute in the Content on the Website any material or other information that:
    a) infringes any Intellectual Property Rights;
    b) is in breach of any law, statute, or regulation;
    c) is defamatory, libellous, unlawfully threatening, politically sensitive or harassing;
    d) is obscene, pornographic or indecent;
    e) contains any viruses or other computer programs intended to damage, detrimentally interfere with, surreptitiously intercept or expropriate any personal information; or
    f) is not solicited.
